The EU Judicial Legal Assistance through Electronic Delivery Document with Certain Research of Blockchain

【Abstract】Electronic service of documents is an emerging method in civil proceedings in EU member states. National procedural codes are opening up more and more to this option although the types of cases and the range of addressees eligible for this method of service varies considerably. Expanding electronic service for delivery of judicial or extrajudicial documents in every country will be increasingly popular in the future. Our impact assessment concluded that digitalization and electronic communication offers benefits for the judiciary by simplifying and speeding up cross-border judicial proceedings and cooperation. Messages containing confidential information must be encrypted or secured in some other manner because the security, safeguards, privacy, and modification of the defects of the technology are connected with authentic and human rights. The basic regulation of judicial electronic delivery abroad appears to be governed by the Council Regulation (EC) No 1393/2007, but this code is not clear and should be revised to be transparent and directly applied.
