A Blockchain-Based Approach for Secure Data Migration From the Cloud to the Decentralized Storage Systems

【Abstract】The use of cloud computing has been on the rise. However, there are many challenges associated with the cloud, such as high bandwidth requirements, data security, vendor lock-in, and others. The recent rise of decentralized file systems (DFSs) can help mitigate some of these challenges. However, they have some limitations of their own, and the current solutions do not provide any mechanism for implementing access control policies. This becomes a hurdle for migrating sensitive data from the cloud as the associated authorization policies cannot be migrated to the DFSs. In this paper, the authors address the problem of migrating data and associated authorization policies from the cloud to the DFS. They have applied the approach on the content and policies from an actual cloud provider, and it migrates data from AWS S3 to the IPFS, and the resource-based authorization policies specified at AWS are added to a custom blockchain solution. The authors have provided implementation details to justify the practicality of the approach.

HFabD plus M: A Web-based Platform for Automated Hyperledger Fabric Deployment and Management

【Abstract】Hyperledger Fabric is an open-source private permissioned blockchain that supports the use of smart contracts (chaincode). It is aimed mainly at private networks of companies. To serve the different needs of each company and to be flexible in customer requirements, it consists of various adaptive components. Although this structure efficiently addresses a wide range of needs, deploying such a network for research purposes or rapid development is complex. In this paper, we present a web-based system architecture for the automated deployment of a Hyperledger Fabric network, and in addition, we describe the tools needed to manage and update such a network. Finally, as a proof-of-concept, we implement the proposed architecture to demonstrate the feasibility of our approach.

Maintaining Review Credibility Using NLP, Reputation, and Blockchain

【Abstract】This paper presents a novel approach to review credibility in a marketplace, which leverages trust in reviews and reputation of the parties who provide them. We propose an architecture for a reputation-based review evaluation system, which is built on top of the blockchain system, in order to ensure correct and trustworthy assessments. In our proposal, trustworthiness of reviews is evaluated using NLP-specifically, sentimental analysis-and the reviewers' reputations are adjusted according to this evaluation. These reputations are stored on the blockchain and used as an asset for the consensus process when mapped to stake. We introduce a new type of transaction, a review transaction, which stores the review data and evaluation results. In testing, our simulation results showed that the NLP component incurred a reasonable delay this new type of review transactions. Additionally, we measured the time required to add a standard payment transaction in Algorand and that for our review transaction and observed comparable results. Also, we observed that the NLP component ensures an accurate credible evaluation (compared to the ground truth) of the product review texts. With this new model, we have moved towards showing how NLP can used for self-regulating trust management in a decentralized marketplace ecosystem.

On coexistence of decentralized system (blockchain) and central management in Internet-of-Things

【Abstract】Network is composed of logical nodes and edges for communications. Atomistic component of things connected to the network is a memory chip. Accordingly, the unique linkage of a memory chip and a logical node can be a promising to resolve the root-of-trust problem on the Internet-of-Things. For this aim, we propose a protocol of challenge-response using a memory chip. For the central management, a central node controls the entry of electronic appliances with a memory chip into the network, and excludes a fake node (e.g., the spoofing entity) from the network that the central node manages. For the decentralized communications, Merkle's tree turns out being composed of memory chips to which the logical nodes are uniquely linked, respectively. The root of Merkle turns out being the memory chip that stores the latest record of data transaction. We can register this memory chip as a new block by satisfying the requirement of the proof-of-consensus. After blocks are chained, it gets harder for even the central node to manipulate transaction record among memory chips. By this way, the decentralized system (e.g., blockchain) and the central management can coexist. A new idea of security state is also discussed briefly.

【Abstract】International health organizations advocate for health care with greater quality and safety, reflecting population needs. However, current health services are inefficient, facing problems of inadequate treatment, human resources, infrastructure, and high costs. Digital health technologies play an increasingly important role in healthcare services such as remote care and vital signs monitoring. The Internet of Medical Things (IoMT), which is a customized version of the Internet of Things (IoT), is increasingly important as it interconnects different medical devices, sensors, patients, and doctors, among others. This brings several benefits in improving health services. Nevertheless, in the IoMT environment, there are several challenges to overcome. Blockchain technology, a distributed ledger, with its immutability, transparency, and anonymity features, is being used in IoMT to help overcome these challenges. In this paper, a systematic review was carried out to identify the research topics of blockchain application in IoMT, the challenges in IoMT, how blockchain helps to overcome them, and the maturity stage of those works. The review results allowed us to identify five research topics in which the main ones are authentication and intrusion detection. This review shows an overview of current research on this subject, giving the possibility of directing other research works, or optimizing the existing ones.

Harpocrates: Privacy-Preserving and Immutable Audit Log for Sensitive Data Operations

【Abstract】The audit log is a crucial component to monitor fine-grained operations over sensitive data (e.g., personal, health) for security inspection and assurance. Since such data operations can be highly sensitive, it is vital to ensure that the audit log achieves not only validity and immutability, but also confidentiality against active threats to standard data regulations (e.g., HIPAA) compliance. Despite its critical needs, state-of-the-art privacy-preserving audit log schemes (e.g., Ghostor (NSDI '20), Calypso (VLDB '19)) do not fully obtain a high level of privacy, integrity, and immutability simultaneously, in which certain information (e.g., user identities) is still leaked in the log. In this paper, we propose Harpocrates, a new privacy-preserving and immutable audit log scheme. Harpocrates permits data store, share, and access operations to be recorded in the audit log without leaking sensitive information (e.g., data identifier, user identity), while permitting the validity of data operations to be publicly verifiable. Harpocrates makes use of blockchain techniques to achieve immutability and avoid a single point of failure, while cryptographic zero-knowledge proofs are harnessed for confidentiality and public verifiability. We analyze the security of our proposed technique and prove that it achieves non-malleability and indistinguishability. We fully implemented Harpocrates and evaluated its performance on a real blockchain system (i.e., Hyperledger Fabric) deployed on a commodity platform (i.e., Amazon EC2). Experimental results demonstrated that Harpocrates is highly scalable and achieves practical performance.

Investors and customers are demanding product visibility and provenance to make investment and/or buying decisions. The supply chain disruptions that has rattled the industry in the last couple of years has added fuel to the fire, with supply chain resilience as a key factor. Blockchain solutions with the ability to enable data sharing across multi-party systems, track and trace multi-tier chain-of-custody data flows and provide immutable, verifiable proofs is well-positioned at the intersection of supply chain resilience and the circular economy needs. This article will focus on how reporting with block chain solutions may provide the opportunity for companies to enhance stakeholder trust in their ESG data and its communication.

【Abstract】Smart contracts (SCs) are a set of logical procedures that can be run by individual peers participating within a Distributed Ledger Technology (DLT) network. By design, smart contracts inherit many of the benefits of DLT, including its immutability, scalability and security properties. Nevertheless, they may introduce additional attack vectors, which can lead to cybersecurity explorations that could jeopardize the endapplication's ability to operate as intended or result in data leaks, and privacy violations. In this work an exploration of known problems, and possible attack scenarios will be presented. This is followed by a set of proposed best practices that are intended to assist developers, researchers and other relevant stakeholders to develop secure SC implementations.

MnemoSys: A Conditional Probability Estimation Protocol for Blockchain Audited Reputation Management

【Abstract】Reputation systems have been one method of solving the unique challenges that face distributed networks of independent operators. Fundamentally, historical performance must be considered in a way that attempts to predict future behavior, optimize present functionality, and provide some measure of immutable recording. In this paper, a three-part system, MnemoSys, is proposed to solve this diverse set of problems. First, historical performance is dynamically weighted and scored using geometrically expanding time windows. Second, a quorum is abstracted as a restricted Boltzmann machine to produce a conditional probability estimate of log-normal likelihood of good-faith behavior. Third, all rewards and punishments are recorded on an immutable, decentralized ledger. Our experimentation shows that when applied iteratively to an entire network, consistently under-performing nodes are removed, network stability is maintained even with high percentages of simulated error, and global network parameters are optimized in the long-term.

Attributes Aware Relationship-based Access Control for Smart IoT Systems

【Abstract】The pervasive nature of smart connected devices has intruded on our daily lives and has become an intrinsic part of our world. However, the wide use of the Internet of Things (IoT) in critical application domains has raised concerns for user privacy and security against growing cyber threats. In particular, the implications of cyber exploitation for IoT devices are beyond financial losses and could constitute risks to human life. Most deployed access control solutions for smart IoT systems do not offer policy individualization, the ability to specify or change the policy according to the individual user's preference. As a result, currently deployed systems are not well suited to specify access control policies in a multi-user environment, where users access the same devices to perform different operations. The system's security gets tricky when the smart ecosystem involves complicated social relationships, much like in a smart home. Relationship-based access control (ReBAC), widely used in online social networks, offers the ability to consider user relationships in defining access control decisions and supports policy individualization. However, to the best of our knowledge, no such attempt has been made to develop a formal ReBAC model for smart IoT systems. This paper proposes a ReBAC(IoT) dynamic and fine-grained access control model which considers the social relationships among users along with the attributes to support an attributes-aware relationship-based access control model for smart IoT systems. ReBAC(IoT) is formally defined, illustrated through different use cases, implemented, and tested.

【Abstract】In case of an accident between two autonomous vehicles equipped with emerging technologies, how do we apportion liability among the various players? A special liability regime has not even yet been established for damages that may arise due to the accidents of autonomous vehicles. Would the immutable, time-stamped sensor records of vehicles on distributed ledger help define the intertwined relations of liability subjects right through the accident? What if the synthetic media created through deepfake gets involved in the insurance claims? While integrating AI-powered anomaly or deepfake detection into automated insurance claims processing helps to prevent insurance fraud, it is only a matter of time before deepfake becomes nearly undetectable even to elaborate forensic tools. This paper proposes a blockchain-based insurtech decentralized application to check the authenticity and provenance of the accident footage and also to decentralize the loss-adjusting process through a hybrid of decentralized and centralized databases using smart contracts.

Sharding and Its Impact on Fork Probability

【Abstract】Blockchain is an emerging technology that has encountered a number of challenges, including forks and low transaction processing rates compared to other payment systems. While sharding was designed to resolve the problem of low processing rates, it also increases the scalability of the network. However, its effect on the probability of forking is still unclear. Our primary goal in this study is to determine the impact of adding new shards to a blockchain on the probability of forks occurring. In order to achieve this goal, we first developed a novel simulator which enables us to simulate sharded networks. Then, we examined the effect of sharding on fork occurrence. Two EIP-1559 enabled networks containing 60 and 120 nodes have been studied in several experiments. As a result of our study, we have found that adding one shard on average results in a 60% reduction in the number of orphan blocks. In addition, we have proposed a fork probability model which results in 23% and 15% reductions for networks with 60 and 120 nodes, respectively.

Performance Study for Improving Throughput in Hyperledger Fabric Blockchain Platform

【Abstract】Hyperledger Fabric (HLF) is a blockchain platform that supports immediate finality of transactions and can be used in various application domains such as Supply chain, Health etc. Researchers have reported significant improvement in throughput, in HLF v1.0, based on experiments carried out with certain optimizations when Kafka is used as a consensus mechanism. In our paper, we supplement the above study with a few more guidelines that improve the throughput. The guidelines have been derived on top of HLF platform v2.2.3 with Raft and SmartBFT consensus mechanisms and with different Tx sizes. Our experimental study has shown 3 to 5 times improvement when compared to default configuration settings of HLF v2.2.3 in the case of Raft.

Towards faster settlement in HTLC-based Cross-Chain Atomic Swaps

【Abstract】Hashed Timelock (HTLC)-based atomic swap protocols enable the exchange of coins between two or more parties without relying on a trusted entity. This protocol is like the American call option without premium. It allows the finalization of a deal within a certain period. This puts the swap initiator at liberty to delay before deciding to proceed with the deal. If she finds the deal unprofitable, she just waits for the time-period of the contract to elapse. However, the counterparty is at a loss since his assets remain locked in the contract. The best he can do is to predict the initiator's behavior based on the asset's price fluctuation in the future. But it is difficult to predict as cryptocurrencies are quite volatile, and their price fluctuates abruptly. We perform a game theoretic analysis of HTLC-based atomic cross-chain swap to predict whether a swap will succeed or not. From the strategic behavior of the players, we infer that this model lacks fairness. We propose Quick Swap, a two-party protocol based on hashlock and timelock that fosters faster settlement of the swap. The parties are required to lock griefing-premium along with the principal amount. If the party griefs, he ends up paying the griefing-premium. If a party finds a deal unfavorable, he has the provision to cancel the swap. We prove that Quick Swap is more participant-friendly than HTLC-based atomic swap. Our work is the first to propose a protocol to ensure fairness of atomic-swap in a cyclic multi-party setting.

【Abstract】While much research focuses on different methods to secure blockchain, information on the chain needs to be accessed by end-users to be useful. This position paper surveys different ways that end-users may access blockchains. We observe that between the two extremes of running a full node and fully utilizing a trusted third-party service, many solutions regarding light nodes are emerging. We analyze these solutions based on three basic properties of web communication: integrity, availability and privacy. We conclude that currently, the best way to access a blockchain while maintaining these three properties is still to run a full node. We consider it essential that future blockchain accessibility services should be built while considering these three expectations.

When permissioned blockchain meets IoT oracles: An on-chain quality assurance system for off-shore modular construction manufacture

【Abstract】Advanced information technologies such as the Internet of Things (IoT) and Modular Construction (MC) bring new potentials to the construction industry. The trustworthiness is critical for MC quality assurance (QA), particularly in the offshore manufacture stage. The emerging blockchain technology which enables transparent, traceable, and immutable information exchange in distributed systems opens a new avenue for managing off-shore MC. However, the real-time data collection and update, as well as permitted data access are two critical concerns in utilizing blockchain for MC. The permissioned blockchain and IoT is considered as feasible solutions. Thus, this paper presents a three-tier architecture of permissioned blockchain with IoT oracles: the infrastructure layer, platform layer, and service layer. IoT devices in the infrastructure layer act as oracles of the blockchain, feeding real-world data from MC components promptly on time through trusted APIs. A permissioned blockchain network in the platform layer provides authentication functions to ensure authorized access to QA-related channels. A mobile-based application named e-InStar in the service layer provides user-friendly UI for multi-stakeholders to access the QA system named e-inspection 2.0. The three-tier architecture design can thus respond to the data access and data updating needs for MC QA, specifically for multi-stakeholders cooperation requirements. An application case of a housing project validated the permissioned blockchain in the e-Inspection 2.0 system in two aspects: (1) system transparency and security, and (2) users' satisfaction with data collection and QA functions.

The IEEE Blockchain Transactive Energy Demo Initiative

【Abstract】In 2021 and 2022, the IEEE Blockchain Transactive Energy (BCTE) initiative, a volunteer- staffed outreach effort by the IEEE Future Directions committee, issued requests for proposals (RFPs) for innovative demonstrations of blockchain transactive energy technology. Demos selected by the screening committee were awarded $ 10,000 each. The intent was to foster interest and activity in actually implementing and deploying blockchain transactive energy systems. The RFP process was open to any team worldwide at an academic institution, utility, large company, nonprofit, or startup. Since this is the first time any IEEE group has run such a demo competition, this paper aims to demonstrate the initial results of the competition.

Integrating blockchain-based access control model TBAAC for privacy and accountability for water science project

【Abstract】This research came from the need for a client application where researchers want to store and share their large-sized research data among their community. This application necessitates data exchange while respecting the media content owner's privacy and sharing rights. To develop this client decentralized application, each issue related to storage, propagation capacity, or access permissions needs to be addressed along with the network structure and execution flow to work as swiftly as possible. To mitigate these challenges, we introduce the TBAAC (Token-based attributed access control) management, a modified attribute-based access control (ABAC) scheme to explore the full potential of the used schemas and strategies in a blockchain-supported client application. The presented tokenbased attributed access control has been validated through regress simulations and specified use cases of the DWS client application.

SciLedger: A Blockchain-based Scientific Workflow Provenance and Data Sharing Platform

【Abstract】Researchers collaborating from different locations need a method to capture and store scientific workflow provenance that guarantees provenance integrity and reproducibility. As modern science is moving towards greater data accessibility, researchers also need a platform for open access data sharing. We propose SciLedger, a blockchain-based platform that provides secure, trustworthy storage for scientific workflow provenance to reduce research fabrication and falsification. SciLedger utilizes a novel invalidation mechanism that only invalidates necessary provenance records. SciLedger also allows for workflows with complex structures to be stored on a single blockchain so that researchers can utilize existing data in their scientific workflows by branching from and merging existing workflows. Our experimental results show that SciLedger provides an able solution for maintaining academic integrity and research flexibility within scientific workflows.

【Abstract】Recently, the usage of blockchain on swarm UAV applications has gained popularity due to the simplicity and security of the designed frameworks. Applications of drones to precision architecture have also been a prominent research topic for years. However, architectures that use drones as a service (DAAS) for such applications are still lacking some detailed analysis. This paper addresses the known problems and challenges of swarm UAV networks, such as availability, route de-confliction, confidentiality and authenticity, and energy consumption. It presents a conceptual solution and architecture for blockchain and computer vision-assisted precision agriculture applications of swarm UAVs through a combination of early designs of agriculture-specific system components and methods adapted from proposed frameworks for other fields in the industry.

Elesto Protocol: Self-Sovereign Identity System

【Abstract】The key to the emerging digital society and economy is digital identity, a fundamental component of digital transformation in representing any real-world entity in digital form. An effective digital identity is essential to secure a successful digital future, especially as the demand for digital services grows. Since the genesis of digital identification, numerous identity management (IdM) systems have been developed and enforced to address the increasing need to manage identities based on the needs of individuals and organizations. This advancement of IdM systems offers an incremental process that leads the user to gain control of identity ownership and personal data while raising identity management concerns such as sovereignty, storage, access control, security, privacy, and safeguarding. Selfsovereign identity (SSI), recently recognized as a promising IdM, can provide sovereignty to the identity owner while addressing these concerns. The Elesto protocol is an emerging open-source, public permissionless blockchain-based implementation that uses SSI for identity management for users, organizations, and other entities. The protocol leverages W3C specifications for decentralized identifiers (DID), verifiable credentials ( VC), DIDComm messaging specifications, and SSI agents. The Elesto protocol is an application-specific blockchain implementation using the Cosmos SDK framework, Tendermint Proof-of-Stake (PoS) consensus, the Inter-Blockchain Communication protocol (IBC), and design satisfies all of the fundamental requirements and principles of SSI. This paper presents the design and implementation of the Elesto protocol as an identity infrastructure. Three use cases illustrate how the protocol helps overcome the highlighted problems by decentralizing or extending functionalities in the blockchain infrastructure.

【Abstract】Receiving an academic certificate is a testimony that the individual receiving the certificate has achieved a number of specified learning outcomes. Still, due to the improvement in technology and the proliferation of the Internet, questionable businesses started offering fraudulent certificates and certain organizations started creating their own accreditation organizations that make it difficult to distinguish between fake and real academic certificates. In response to these problems, certificate verification policies and -processes are changing as electronic verification of certificates gradually gain popularity and are deployed in some institutions. Blockchain technology has emerged as a means of offering tamper proof digital certificates. This study examines the prevalent system of certificate verification and presents a framework for the implementation of blockchain technology in the context of Nigeria.

【Abstract】Peer-to-peer (P2P) tokenised energy trading has seen much research interest in recent years. Despite this, the concrete physical workings of such marketplaces are rarely explained in the extant literature. This paper discusses notional P2P marketplaces with regard to their real-world implementation. The analysis of the physical/electrical layer and metaphorical token layer are kept distinct. Tokenised energy is conceptualised here as a dynamic license to consume, which serves as a flow of legitimacy for energy consumption in P2P schemes as typically proposed. Ledger structures, including centralised and decentralised/blockchain examples are examined. With the above points in mind, the workings of a notional blockchain-aware smart meter are described. The authors argue that while P2P energy trading may be a useful tool for regulators and for integration into smart token ecosystems, the drawbacks associated with decentralised tokenised energy markets may outweigh the apparent benefits at present.

A Novel Machine Learning-assisted Pairs Trading Approach for Trading Risk Reduction

【Abstract】The cryptocurrency market has been growing rapidly in recent years. The volume of transactions and the number of participants in the cryptocurrency market makes it huge enough that we cannot ignore it. At the same time, the global stock market has also reached a new height in the past two years. However, due to the COVID epidemic and other political and economic-related factors in the last two years, the uncertainty in the capital market remains high, and shortterm large fluctuations occur frequently; thus, many investors have suffered substantial losses. Pairs trading, an advanced statistical arbitrage method, is believed to hedge the risk and profit off the market regardless of market condition. Amongst the vast literature on pairs trading, there have been investors trading a pair of cryptocurrencies or a pair of stocks using machine learning or empirical methods. This research probes the boundary of utilizing machine learning methods to do pairs trading with one stock asset and another cryptocurrency. Briefly, we built an assets pool with both stocks and cryptocurrencies to find the best trading pair. In addition, we applied mainstream machine learning models to the trading strategy. We finally evaluated the accuracy of the proposed method in prediction and compared their returns based on the actual U.S. Stock and Cryptocurrency Market data. The test results show that our method outperforms other state-of-the-art methods.

Standardization is one of the most important factors for the success of an emerging technology and requires the support of multiple groups including industry, academia, governments, and other interest communities to boost its sustainable development, interoperability, and ease of use. Several international standards organizations (IEEE, ISO, and ITU-T) have led the Blockchain technology and application standards development in recent years. This paper provides a comprehensive review of applications of Blockchains to the energy and power grid domains, and the standard development activities by the IEEE Standards Association (SA). In addition, up-to-date industrial reflections are presented on the Energy Blockchain landscape collected via dedicated online surveys and meetings with industrial and academic experts.

【Abstract】The Digital Green Transition of the energy industry is accelerating as decarbonization and digitalization of the power market and system are gaining momentum. Unlocking the full and real potential of local energy markets is among the opportunities to be demystified in the coming years, with blockchain technology being a prominent enabler. Important subcomponents such as functional and fair local energy pricing mechanisms and management algorithms will be required for next-generation digital local energy trading and management platforms. Even though rapid digitalization of the energy sector offers considerable advantages, it also increases the cyber-physical risk levels of energy systems in general. The proposed framework of this paper accommodates considerable undiscovered aspects of democratization of the energy systems and future digital shared economy conventions. Nevertheless, privacy concerns must be addressed in tandem with the cyber-physical security of local energy markets and their ecosystem. This work proposes a joint privacy and cyber-physical security framework designed for local energy markets to improve cyber-physical resilience. All related parts, such as blockchain technology and self-sovereign identity, are used in an organized way to create a possible solution.

Balancing privacy and accountability in digital payment methods using zk-SNARKs

【Abstract】In this paper we propose and implement a digital permissioned decentralized anonymous payment scheme that finds a balance between anonymity and auditability. This approach allows banks to ensure that their clients are not participating in illegal financial transactions, whilst clients stay in control over their sensitive, personal information. Existing anonymous payment schemes often provide good privacy, but only little or mostly no auditability. We provide both by extending the Zerocash zk-SNARK based approach and adding functionality that allows for customer due diligence 'at the gate'. Clients can do fully anonymous transactions up to a certain amount per time unit and larger transactions are forced to include verifiably encrypted transactions details that can only be opened by a select group of 'judges'.

【Abstract】Different industries have been evolving to accept and implement blockchain technology for a variety of use cases either for automation purposes, for internal/external process integration amongst multiple entities or for provenance use cases such as in supply chain using blockchains tracking and tracing abilities. The telecommunications industry itself has adopted blockchain technology in areas like wholesale roaming, identity as examples. The focus of this paper is implementation of tokenization, Stablecoins, and digital assets in the telecom industry. The paper provides a brief introduction to tokenization, Stablecoins, digital assets and use case examples from the telco industry in the adoption and deployment of tokens, Stablecoins and overall digital assets. The paper argues the case for tokenization and use of Stablecoins in the telecommunications industry. For instance, can we as an industry imagine incentivizing open-source development via a telco token? The blockchain space involves various stakeholder groups which includes telecom operators, vendors, internet companies, technology partners, regulators etc. and any successful implementation involves managing an eco-system play amongst these requiring strong governance. The authors also propose additional research as next steps particularly for economic modelling of telco token economy and a cybersecurity risk assessment.

【摘要】区块链存证被提交为诉讼证据已较为普遍,但是区块链存证真实性审查仍存在信任过度、技术回避、对象偏离、标准模糊等问题。在基础理论上,应从证据法学上厘清区块链存证的定位及在证据真实性上的证明逻辑;在审查方法上,建立区块链存证真实性审查方法的基本体系,防止忽视对区块链存证的工具性与电子数据本身的区分,分清存证平台性质对审查的影响;在证据规则上,可从证明责任、司法推定规则、平台资质准入三个方面,完善发挥区块链技术司法证明作用的规范基础。

【摘要】对于以虚拟货币为犯罪对象的案件,在司法实践中存在明显的同案不同判现象。究其原因,关键在于对虚拟货币的法律属性认识不同。虚拟货币在技术属性上表现为经过复杂计算而生成的一串数字编码,但在法律属性上表现为具有效用性、稀缺性和可支配性的财物。正因为虚拟货币具有价值性,故其区别于在计算机信息系统中存储、处理或传输的普通数据,因而对非法获取他人虚拟货币的行为不能认定为非法获取计算机信息系统数据罪等计算机犯罪,而应认定为盗窃罪或诈骗罪等财产犯罪。虚拟货币不是货币(法币)、准货币,而是一种特殊的虚拟商品,对这类案件的犯罪数额应当坚持被害人损失标准,具体计算时可以犯罪行为发生之日其在域外交易平台的平均交易价格作为参考。

【摘要】随着元宇宙相关产业的发展,如何高质量地开发元宇宙空间,成为学界和业界共同关注的重要议题,而元宇宙空间权也在此背景下日益受到重视。对此,程金华、张豪曾撰文指出,要以“准物权”模式解决元宇宙中的空间权益冲突,这在一定程度上为弥合虚拟和现实间的空间权利分歧提供了理论参考。但需要指出的是,元宇宙空间权并非单数概念,其权利结构具有典型的复合性特征。目前元宇宙空间权所涉及的公共利益、数据安全、个人隐私、相邻权等方面的矛盾和风险日益突出;而以程文为代表的,诉诸传统部门法理论的保护模式,虽关注到了元宇宙空间权保护的不同侧面,但难以实现对元宇宙空间权整全意义上的保护。对此,应该看到元宇宙构成的数据性这一底层逻辑,以数据权利束为基础探索元宇宙空间权综合保护体系,以充分推进元宇宙空间的有效开发和利用。

【摘要】全球各国中央银行主导的CBDC研发和测试仍处于起步阶段,但基于CBDC跨境应用需求和监管紧迫性不断增强,未来CBDC跨境测试范围可能进一步扩大,CBDC跨国合作将迈向新台阶。但是,CBDC跨境使用以及扩大应用范围将对各国金融监管提出新的挑战,除了技术层面可能存在的障碍之外,监管环境、共识规则、安全及稳定性等问题亟待协调解决。对此,全球各国中央银行、国际组织等迫切需要共同探索建立基于共识基础的CBDC应用平台,考虑制定更具包容性、安全性和中立性的CBDC国际规则,尊重CBDC主权地位,维护全球金融稳定性。

【摘要】为有效厘清区块链技术在应急管理中的研究现状,采用系统文献综述(SLR)与系统评价和元分析的首选报告项目审查方法,综合分析从Web of Science和中国知网期刊数据库中确定的与主题相关的58项研究;总结区块链技术在应急管理中应用所面临的挑战,并从健全法律和制度体系、加速推进区块链核心技术突破、加强专业化人才队伍建设、实现区块链与其他技术的集成与协同4个方面,展望学术界未来关注的潜在主题。结果表明:区块链技术在应急管理中的应用处于初期的蓬勃发展阶段。当前研究主要围绕数据管理(40.3%),效率提升(40.3%)和概念发展(19.4%)3类主题开展,这3个主题可细化为8个次主题。区块链技术在应急管理中的应用呈现出:技术功能改进的需求,应急数据高效管理的需求,应急数据安全性、完整性和数据共享效率的需求。
