【Abstract】The digital economy is leading to substantial changes in the financial sector. Not surprisingly, it raises a number of sensitive legal issues. (1) New technologies and big data are expected to increase efficiency in the financial sector. But some limits need to be drawn in order to protect the fundamental rights at stake, such as privacy and non-discrimination. (2) The application of the so called supervisory technology (SupTech) can improve financial supervision, but it does not seem to alter its legal foundations. (3) We have to consider the role that big techs might play in the financial system and whether they should be subject to a tailor made regulation. (4) Digital currencies take us to the basics of what money is and to wonder what the role of the State is in relation to it. (5) Finally, we have to consider the implications that the creation of an official digital currency could have for the financial system.

【摘要】数字经济正在使金融业发生重大变化。毫不疑问它也引发了一些敏感的法律问题。 (1) 新技术和大数据有望提高金融部门的效率。但是,为了保护受到威胁的基本权利,例如隐私和不歧视,需要划定一些限制。 (2)所谓监管技术(SupTech)的应用可以改善金融监管,但似乎并没有改变其法律基础。 (3) 我们必须考虑大型科技公司在金融体系中可能扮演的角色,以及它们是否应该受到量身定制的监管。 (4) 数字货币让我们更能了解货币、国家在货币方面的作用的基础知识。 (5) 最后,我们必须考虑官方数字货币可能对金融体系产生的影响。
